Neuroscience, Neuroprotection, and Neurorights: Human Brain Rights and the Brazilian Constitutional Advances

Believing it essential to reflect on the expansion of the legal and normative understanding of human dignity in this new digital context, we present this essay to address the necessary recognition that must exist between technosocial dynamism and the human subject, in order to assist in the construction of theoretical bases that demonstrate that scientific and technological development must serve humanity and respect life, equality and freedom. To this end, we will begin our analysis by briefly examining the social evolutionary milestones related to this subject and the ethical impulses derived from them. In the second part, we will examine the current legal stage of the protection of the human mind in the international context. Finally, we will analyze the possibilities that Brazil has regarding the legal treatment of these issues, using a descriptive exposition and attentive to the legislative changes underway in the country.
