Following the United Nations’ Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power in 1985, the Omani legislator intervened by enacting legal provisions that impose stricter penalties for crimes within the family. These provisions also establish substantive and procedural protections for victims of domestic violence, ensuring their safety and prevention. This chapter focuses on key crimes within the framework of domestic violence, such as murder, rape, and issues related to the exercise of legal rights. The significance of this research lies in its practical initiative toward achieving broader and more comprehensive protection for victims of domestic violence. It also contributes to strengthening family stability by improving legislation and justice procedures to ensure social justice and protect human dignity. The research problem centers on the effectiveness of criminal protection for domestic violence victims under Omani legislation. The study adopts a descriptive approach to identify and describe domestic violence crimes and an analytical approach to examine the legal provisions related to crimes committed within the family. The study concludes that there is a need to establish a specialized Family Court for domestic violence cases, accompanied by substantive and procedural legislative amendments that align with a rights-based approach and human rights principles. Additionally, it emphasizes the necessity of developing a clear mechanism for reporting, monitoring, prosecuting, and rehabilitating perpetrators of domestic violence.

摘要

The legal interest in victims of domestic violence has been increasing, as it is a social phenomenon that affects every society. Many individuals, especially women and children, suffer from it.
