The Legal Nature of Domain Names and Their Relationship to Trademarks in the Digital Environment

This research examines the legal characteristics of domain names and their connection to trademarks within the digital landscape, emphasizing the legal considerations related to the utilization of domain names on the internet and their influence on the digital identity of businesses and consumer rights. Given the swift advancements in the digital realm, domain names have emerged as pivotal in establishing a robust digital identity and facilitating communication between corporations and their customers. The study culminated in several significant conclusions, particularly noting that domain names are frequently regarded as an integral component of a trademark, especially when employed as marketing instruments. Furthermore, the research identified both legal similarities and distinctions between domain names and trademarks, prompting inquiries into the appropriate legal treatment of each. The importance of merging trademarks with websites to bolster digital identity and safeguard consumer interests in the online marketplace was also underscored. In light of these findings, the study advocates for the revision of legal frameworks to incorporate mechanisms that protect the rights of both trademark owners and domain names within the digital context, alongside enhancing legal oversight of domain names that could infringe upon consumer rights. It also calls for the adoption of policies that would foster digital market innovation plus guaranteed protection for consumers against any illegal practices.
