A Legal Analysis of Flexible Employment Contracts in the Digital Era

This research investigates the legal framework that governs flexible employment contracts, with a particular emphasis on the stipulations outlined in the 2024 Flexible Work System. The importance of this study is underscored by its focus on the rising significance of flexible work as a new and increasingly pertinent form of employment within the legal realm. It assesses the legal safeguards provided to both parties engaged in such contracts and underscores the rights afforded to workers within this system. A central inquiry of the study pertains to the constitutionality of the Flexible Work System and its alignment with constitutional principles. Utilizing a descriptive and analytical approach, the research ultimately finds that flexible employment contracts frequently function beyond the reach of administrative oversight and inspection, resulting in a deterioration of workers’ rights. To mitigate these issues, the study advocates for the establishment of a comprehensive legal framework specifically designed to address the distinct characteristics of flexible employment, thereby ensuring sufficient protection for all parties involved and promoting a balanced approach to this evolving mode of work.
