The integration of Artificial Intelligence (AI) in intellectual property management has sparked significant debate regarding its impact on patentability and authorship. This study first reviews the contemporary legal landscape surrounding inventions and copyright and then examines the role of AI-driven models, particularly through prompt engineering techniques, in generating novel patent claims. By leveraging large language models (LLMs) such as ChatGPT, Gemini 2.0, DeepSeek R1, Llama 3.1, and Claude Sonnet 3.5, the research explores how AI can enhance the inventive process, supporting human creativity while raising concerns about inventive cannibalism—the potential fragmentation and appropriation of innovation.
