Problems of Using LegalTech in the Context of the Development of Alternative Dispute Resolution Methods in the Investment Field

The article explores the discussion aspects of the use of LegalTech tools within the framework of the currently actively developing alternative dispute resolution methods in the field of investment activities. The relevance of studying these issues is predetermined both by their interdisciplinary nature, the impact of technological progress, which mediates the expansion of the range of relevant means, and the growing number of legal (including investment) disputes resolved through alternative dispute resolution procedures, as well as the qualitative modification of the latter (including as a result of digital transformation). In turn, the development of this practice raises a number of problems. At the same time, a certain fragmentation of regulation of the relevant issues in the Russian legislation (although it has been actively updated in recent years) and the novelty of the practice of consideration of the relevant disputes lead to increased interest in foreign trends in this area, in connection with which a significant place in the study is taken by generalizations of comparative-legal nature. Based on the results of the study, conclusions are formulated regarding the prospects for improving domestic legislation and law enforcement, as well as recommendations for practicing lawyers.
