The article is devoted to the analysis of the use of LegalTech technologies in preparing a joint will in terms of preserving and transferring the marital family business as an instrument of minimizing the risks of documents forgery and will distortion of the testator. The authors analyze scientific and practical significance of introducing amendments to legislation in the field of joint wills of spouses. They also investigate debatable issue of introducing the legislative concept of “family business”. The scientific novelty of the conducted comprehensive legal research is based on its results, which affect the specifics of individual legal institutions, such as the joint will of spouses using LegalTech, as well as the institute of sub-appointment of an heir. The purpose of this study is to identify current trends in judicial practice and analyze the development of legislation on the use of LegalTech technologies in preparing a joint will of spouses and the possibility of preserving and transferring the family business by inheritance as a family value. Taking into account the analysis of the current norms of Russian legislation, as well as the positions of scientists in this field, the researchers propose options for reforming legislation to eliminate existing problems. The paper suggests that the institution of sub-appointment of an heir should be used without fail in order to preserve business as a family tradition passed down from generation to generation within the same family.
