Chapter 8 summarizes and evaluates the findings of the previous chapters and provides recommendations. The chapter discusses in detail various examples from the implementation of CAFTA-DR and EU-FTAs that illustrate the shortcomings of the TRIPS-plus approach in bilateral FTAs, namely that institutional challenges and socio-political and fiscal constraints in Central America significantly reduce the practical effect of statutory TRIPS-plus obligations mandated by bilateral FTAs. The chapter also argues for a multilateral approach and more focus on institutional and practical improvements.
