This chapter examines the literature on U.S. court cases and policies from 1980 to 2024 that have reduced barriers to higher education for underrepresented student groups, including undocumented students. A database search was conducted to identify peer-reviewed journal articles that analyzed court cases and policies about the barriers undocumented students face in their access to higher education and employment opportunities. The search results show that policies including the DREAM Act, Affirmative Action, and developmental education reform legislation, serve to increase access to higher education for undocumented and underrepresented populations. They also demonstrate the importance for colleges and universities to continue their efforts to increase access to higher education for undocumented students and support them. This research also calls for the need to expand U.S. higher education and pathways for undocumented students to prepare for and successfully enter the workforce.
