Liability of legal persons for criminal offences was introduced in Bulgarian law almost 20 years ago and was amended several times since then. However, the regulation still lacks some of the important features required by international and EU legal instruments dedicated to the fight against serious crime such as terrorism, fraud, corruption, money laundering, etc. Besides, Bulgarian regime of corporate liability for criminal offences lags also in comparison to other jurisdictions in contemporary aspects such as compliance programmes and deferred prosecution agreements. In the beginning of 2024, a draft bill was presented which proposes some amendments to the regulation of corporate liability for criminal offences under the Bulgarian law. Will it bring the improvement necessary to ensure adequate deterrence and sanctioning of corporate crime?
