The Impact of Digital Legal Notifications on Debtors’ Commitment Fulfillment
摘要
In a digital era, legal notices have evolved into emails that act as a formal reminder from the creditor to the debtor regarding the failure to fulfill their obligation. These emails act as explicit digital notices requiring the debtor to meet their obligation within a specified period of time; otherwise, they would face legal consequences. Precisely, the importance of digital legal notice is to inform the debtor upon its electronic means that any delay in meeting their commitment would hurt the vested interests of the creditor. It streamlines this process by shining a due date to the debtor through electronic channels such as email or online platforms; hence, communication is made faster. Not adhering to this forms digital default. Furthermore, digital legal notices more prominently inform the debtor of the legal consequences that might otherwise follow unfulfillment further reinstates the importance as long as execution is still possible. In the impossibility of execution, digital legal notifications take a central place in that procedure, which is more applicable where the creditor is seeking compensation of their actions. The major challenge in this digital setting is to establish the point at which debtor negligence attaches upon receipt of a digital notice, and who should be liable. The consequences have primarily been vested on the debtor when damage arises from mutually binding contracts, but digital notifications bear proof against the debtor of his blame. The burden of proof shifts to the debtor, both to demonstrate that notice was given and also to show that even if notice had been given earlier, damage would still occur. This will also facilitate the infusion of digital notifications, due to an increased level of transparency and will consequently speed up the legal process in the modern age.
