The Role of Technology in Validating Arbitration Awards and Enhancing Commercial Security

This study examines various aspects of the validity of an arbitration award and its enforceability in different legal contexts, with particular emphasis on the role of technology in this context. Generally, in many jurisdictions, to enforce an arbitration award, you must obtain a court order because the award itself is not enforceable. This study used a descriptive approach to analyze the texts of different legal arbitration laws and a comparative method to read the differences between some legal systems in terms of the validity of an arbitration award and the necessary steps to enforce it. This study covers all the aspects and phases that need to be gone through to ensure that an arbitral award is enforceable in order to prove its legal effects and how this can be facilitated through technology.
