Analysis of the Role of Geographical Indications in Enhancing Product Quality, Protection, and Digital Traceability: A Legal and Technological Study
摘要
This research investigates how geographical indications affect the protection and enhancement of product quality linked to specific locations, placing particular emphasis on the role of digital technologies in traceability and authentication. The study evaluates the effectiveness of legal standards and digital instruments utilized in this domain, exploring the impact of geographical indications on product reputation and market value. Additionally, it reviews the efficiency of legal frameworks and digital platforms in safeguarding these indications and contrasts geographical indications with trademarks regarding protection, application, and technological integration. The results indicate that when digital traceability solutions are integrated, geographical indications significantly contribute to improving product quality, boosting competitiveness in international markets, and ensuring authenticity. The research underscores that while existing legal standards offer sufficient protection, there is an increasing necessity to revise laws to keep pace with technological progress and global developments. Moreover, notable distinctions between geographical indications and trademarks were identified, with the former concentrating on geographical and environmental traits, bolstered by digital verification, whereas the latter prioritizes brand identity. In light of these findings, the study advocates for the revision of laws concerning geographical indications, the advancement of digital technologies among producers, and the fostering of international collaboration to enhance global protection and traceability. Additionally, it recommends conducting further research to assess the effects of geographical indications and digital tools on markets while identifying new challenges that may arise.
