Human Rights and Culture, the Arts and Cultural Heritage

This chapter first considers the human rights declarations and treaties related to culture. It then discusses the idea of culture as a distinctive ‘way of life’, in regard to global, regional and national culture and national and minority cultures. The ‘right to cultural participation’ is then examined from the point of view of the relevant UN human rights committee and the point of view of UN member states. The attempts to get culture included in the UN’s sustainable development programmes are then explored. Finally, the chapter briefly discusses heritage and cultural rights, the right to roam and copyright and intellectual property rights.
