New Instruments to Think and Decide. The Last Word in the “Algo-cratic” Era and Human Leadership in the “Algor-ethical” Context: What Law?
摘要
The relationship between Law and Artificial Intelligence requires a deep philosophical-legal reflection that, in a refined algorithmic reality, must seek the most prudent path to remember the inescapability of the cognitive and volitional moments of human action. Adriano Tilgher, Italo Calvino, Hans Jonas and Martin Heidegger are some of the thinkers we will use to propose a conciliatory dialogue between stronger cybernetic instances and more sceptical humanist positions. In order to verify what kind of actions can be expected from the legal phenomenon, we will proceed to an analysis of the current European regulations and the recent doctrinal outlook.
