Awareness, Challenges and Unveiling Obstacles in Implementing Women's Inheritance Rights

Despite the fact that the Hindu Succession Act grants women in Rajasthan state equal inheritance rights, a variety of interrelated societal, educational, economic, and legal factors are the causes of Rajasthani women are unaware of their legal claim to ancestral property. The objectives of the study are to investigate the difficulties and barriers that women have while attempting to inherit family property because they are unaware of their own rights. The study is based on primary data which was collected through ‘Questionnaire’ whereas the required secondary data were collected from books, law journals, and published research papers. The hypothesis was tested in the study using the Chi-Square test, and it was found that even though there is no correlation between Rajasthan's urban and rural living areas, there is a relationship between Rajasthani women's awareness of their inherit rights and their education level. Furthermore, the majority of women are knowledgeable, as indicated by the general awareness level of 74.32%, although a sizeable percentage are not fully informed, particularly with regard to their status as widows or divorcees. The findings point to the necessity of focused awareness initiatives, with a special emphasis on widows and divorcees who seem to be less knowledgeable, to enlighten women about their inheritance rights. The study found that in order to empower widows and eliminate discrimination against women in Rajasthan, legal literacy initiatives and education are crucial. Furthermore, it is recommended that widows’ economic success, social justice, and gender equality be supported—particularly in regions like Rajasthan where patriarchal attitudes and caste structures increase inheritance issues.
