Digital Transformation of Legal Frameworks of Judicial Procedures: A Comparative Study
摘要
The purpose of this study is to determine the process of digitization of judicial procedures and identify the repercussions of the legal ban on the quality of judicial justice and judicial work ban imposed by the Iraqi Federal Electronic Signature and Electronic before Iraqi courts. Also, discover the effects of this ban on efforts to develop the judicial justice system in Iraq, and the aspirations of lifting this ban in line with the reality of the Iraqi judiciary by finding realistic guarantees consistent with the reality of Iraqi courts. The first axis deals with the repercussions of the legal ban on the computerization of judicial procedures in Iraqi law in terms of the effects of this ban on the aspirations of advancing the Iraqi judicial system, and the risks raised by lifting this ban and breaking the stalemate that resulted in the justice of Iraqi judicial work. As for the second axis, we address the challenges of lifting the ban on computerizing judicial procedures according to the reality of the Iraqi judicial system in terms of the scope of lifting the ban and guarantees of the protection of judicial justice. Finally, compare the procedures with Bahrain and Emirates to clarify the similarities and differences.
