As the world intensifies efforts to combat climate change, the Carbon Capture, Utilization and Storage (“CCUS”) arrives as a critical technology to mitigate greenhouse gas emissions. This paper aims at discussing the regulatory landscape surrounding CCUS in Brazil, as the country has vast potential for developing CCUS projects due to its industrial activities, mature oil and gas experience—including regarding geological reservoir technical knowledge—and abundant natural resources. This paper encompasses an analysis of the required infrastructure and technology for developing CCUS projects, as a sensitive matter and a key point under the perspective of economic investment. Also, this work provides an in-depth analysis of the current CCUS regulatory framework under construction in Brazil, evaluating the terms and conditions for implementing the projects. Key regulatory issues such as authorization process, liability issues and legal barriers for industry stakeholders will also be discussed. Furthermore, this paper shall demonstrate Brazil’s challenges for the development of CCUS projects, offering valuable insights to policymakers and industry players to navigate the complexities of regulating and promoting CCUS technologies, while fostering a sustainable and low-carbon future for Brazil.
