In June 2023, the European Union adopted Regulation 2023/1230/EU on Machinery (Machinery Regulation). This regulation replaces Directive 2006/42/EC and sets forth essential health and safety requirements for machinery placed on the European Union (EU) Single Market. Similar to the far-reaching impact expected from the EU AI Act, the Machinery Regulation is anticipated to significantly influence machinery safety standards globally. As such, the new revision of Directive 2006/42/EC addresses novel technologies which challenge product safety in new ways. Indeed, artificial intelligence, the Internet of things and robotics are rather new to the world of machinery and inherent safety protocols need to be reconsidered correspondingly. For example, based on the new tools machinery products are able to let decision making functionalities rely on real-time processing of information, problem solving, mobility, sensor systems, learning, adaptability, and capability of operating in unstructured environments. This chapter provides an overview of the Machinery Regulation, including the institutions responsible for its implementation and enforcement. It explores how manufacturers can achieve compliance with the regulation's requirements. The chapter categorizes machinery based on risk, explaining how these categories influence the specific safety measures needed. Finally, it examines exemptions for specific machinery types and the importance of harmonized standards in demonstrating compliance.
