Between Authentication and Pedagogy: Language, Central Part of Notarial Work

Among the legal professions practicing in France, the “notary” (“notaire” in French) occupies a special position. “Notaries” are appointed and controlled by the State which delegates to them its seal, and prerogatives of public authority. These are public and ministerial officers. Notaries are liberal or salaried professionals organized within a corporation that exercises control over its members. The notary’s role is to provide legal advice, to draft and authenticate documents. Language is at the heart of the notarial activity, whether it is the notary’s scriptural activity or his or her advisory activities to clients. While this profession is comparable to other legal and advisory professions, the place given to language presents specificities that need to be brought to light: How is the language used by these professionals perceived by clients and according to the clienteles? How to characterize the notarial language, its different dimensions, and contexts? How to apprehend the linguistic variations according to the appointments, the interlocutors, the production methods, the notaries both written language and oral language (and the related secondary means of expression)? How do the language(s) mobilized evolve, in connection with societal changes, the notarial function not to mention the socio-demographic evolution of this professional group?
