摘要

This article examines the fundamental elements of a valid contractual relationship, focusing on mutual consent, fair consideration, legal capacity and compliance with relevant laws. Beyond these fundamental components, it highlights the importance of contract quality in terms of drafting precision and clarity. A well-drafted contract is essential to avoid any ambiguities in the language that could undermine its validity. Furthermore, in the midst of legislative change, it is imperative to maintain compliance with applicable laws. To address these challenges, the paper proposes the use of Bayesian networks to model contractual risks, emphasising the need for robust data collection and precise probability specification for each variable. The primary goal of this approach is to assist legal professionals in evaluating contracts and ensuring their compliance with legal standards. By improving the quality of legal documentation, this strategy seeks to protect the interests of all parties to a contract.
