Emerging technologies such as artificial intelligence are challenging the very foundations of the rule of law. As artificial intelligence develops and expands its applicability, the need to adapt legal norms, possibly the ones of constitutional rank, to this new reality imperative becomes. From the perspective of the case-law and of the doctrine, this represents a challenge that requires an innovative and creative approach to deal with the rapid changes in contemporary society. By deeply understanding the complexity of the issues that artificial intelligence presents, we can develop a stronger constitutional framework that protects and promotes the fundamental principles of the rule of law in the digital age by imposing legal limits on what can and can be programmed through the language of the artificial intelligence.
