The article discusses the impact of climate change on human rights and the legal protection of these rights at both international and national levels. The author primarily analyzes the legal situation in Poland, in the context of the current Constitution of the Republic of Poland from 1997, which provides for environmental protection but does not grant individuals the direct right to protect it in court. Instead, the constitutional provisions are treated as programmatic, which limits the ability of citizens to effectively seek legal protection. Despite this, individuals can utilize protections derived from specific statutes. The article suggests that Polish court rulings could be inspired by international precedents; however, the current legal framework in Poland restricts the effective enforcement of climate-related rights.
