Overview Analysis of the Regulation of Environmental, Social and Governance (ESG) Reporting in South Africa

This follows that most investors usually consider and rely on ESG reports when deciding whether to invest in a company or not. ESG reporting entails the disclosure of environmental, social and governance data of a company. ESG reporting is crucial for assisting boards of companies, shareholdersShareholders (Phemelo Magau), and other relevant stakeholdersStakeholders (Moran Ofir/Tal Elmakiess) (Phemelo Magau) (Sadie Blanchard) in assessing the performance of corporations in managing environmental, social and governance risks as well as opportunities. South Africa has been characterised by a haphazard approach to ESG reporting. This challenge could be attributed to the failure of the government, regulatory bodies, and other relevant stakeholdersStakeholders (Moran Ofir/Tal Elmakiess) (Phemelo Magau) (Sadie Blanchard) to adopt robust and consistent requirements and/or frameworks for ESG reporting. Moreover, there has been a failure of policy makers and other relevant stakeholdersStakeholders (Moran Ofir/Tal Elmakiess) (Phemelo Magau) (Sadie Blanchard) to adopt innovative measures such as the regulation and use of innovative technologyInnovative technology (Phemelo Magau) to consistently promote compliance with ESG reporting standards in South Africa. It must be noted that ESG reporting is currently not adequately and sufficiently regulated in South Africa. The regulation of ESG has been done on a piecemeal approach which is both incoherent and haphazard. Without a consistent, clear, and adequate regulatory framework for ESG reporting, most companies will continue to fail to comply with the ESG reporting standards, thus affecting the accuracy of reporting on ESG matters. Accordingly, this chapter seeks to discuss the regulatory framework of ESG reporting in South Africa. Moreover, this chapter will also isolate and discuss the challenges affecting the ESG reporting framework in South Africa. This will be done to recommend possible measures to improve the regulatory framework for ESG reporting in South Africa. Leveraging on and utilising innovative technologyInnovative technology (Phemelo Magau) could enhance ESG reporting and combat the challenges that most companies are faced with in complying with the ESG reporting standards in South Africa.
