The Legal Implications of School Discipline Policies: Balancing Student Rights and School Safety

This qualitative study explores the complex world of school discipline policies and the delicate harmony required between creating a safe learning environment and respecting students’ fundamental rights. This study draws on an in-depth literature review, including those dealing with zero-tolerance policies, and contextualizes the growing literature advocating alternative disciplinary systems. This research highlights the critical role of restorative justice, individualized support frameworks and a focus on essential life skills, and explores ways schools can ensure disciplinary actions focus on recovery and student empowerment. This includes descriptive analysis to examine the effectiveness of a restorative justice framework that aims to keep students safe in schools while respecting their rights in a more equitable environment. This research highlights the urgent need to re-evaluate disciplinary norms and pursue approaches that promote inclusive and nurturing learning environments necessary for students to thrive and well-being.
