Brandeisian Antitrust Under Spotlights

  • Aurelien Portuese

摘要

The New Brandeis Movement, a response to the rise of multinational corporations and accelerated innovation, advocates for regulated competition to limit its pitfalls, and protect consumers and small businesses. Neo-Brandeisians, most commonly found in Europe, favor a precautionary approach to safeguard competition and democratic values. Critics of monopolies overlook the potential benefits of capitalism, while Neo-Brandeisianism advocates for a return to antitrust enforcement without considering economic analysis. The present chapter showcases each Movement’s way of looking at antitrust and the economy, ultimately arguing that the balance between efficiency and societal welfare should be prioritized in shaping antitrust policy for the future.
