Gender and Criminal Justice

This chapter explores the profound gender differences within the Criminal Justice System (CJS), encompassing policing, judiciary, prisons, probation, and rehabilitation services. It highlights how these differences influence crime rates, types of offences, treatment by law enforcement, and sentencing outcomes. The chapter examines criminological theories, including early biological perspectives and modern sociological and feminist theories, to understand gender disparities in criminal behaviour. Empirical data shows that men commit more crimes, particularly violent ones, while women are often involved in non-violent offences. Gender differences extend to interactions with authorities, judicial processes, and incarceration experiences, where women often face leniency but also unique challenges, especially concerning victimization and re-entry into society. The chapter advocates for gender-responsive policies and practices within the CJS to ensure fair treatment, promote justice, and reduce recidivism, thereby contributing to broader societal goals of equality and social justice.
