Life Insurance Contracts in Private International Law

摘要

Insurance contracts, including life insurance contracts in private international law, concern the law applicable to insurance and more specifically to life insurance contracts. Article 7 of the Rome I Regulation deals with special contracts, i.e., insurance contracts. Moreover, the Rome I Regulation also deals with life insurance contracts in Art. 7(3)(c) which provides how and under which criteria and prerequisites parties can choose the applicable law in case of life assurance. This chapter aims to examine the choice of law for life insurance contracts. In doing so, it discusses the Rome I Regulation and critically analyses prior legal instruments, offering also an overall discussion in relation to private international law in life insurance contracts and insurance.
