Reinsurance in PIL

The chapter is a comprehensive discussion of the rank and normative regulation of reinsurance in private international law. Attention has been paid to the importance of the standardization of the international reinsurance market through contractual models. The author has also presented the importance of the cross-border nature of reinsurance relationships at the substantive legal, juridical, and conflict of law levels, which served as a stimulus for further considerations carried out in this chapter. The evolution of the acquis communautaire on reinsurance was highlighted. Reference was also made to the Principles of Reinsurance Contract Law (PRICL) as an example of a draft uniform law on reinsurance contracts. It also uses examples of national law solutions and draws attention to the importance of European jurisprudence, especially in terms of jurisdictional issues. The whole chapter is concluded with doctrinal recommendations.
