This study examines the significance of facial image biometrics in substantiating criminal assertions. It addresses the legal and ethical dilemmas associated with the acquisition of facial images without prior consent and their utilization as evidence against individuals, particularly in the absence of explicit legal provisions recognizing this method as a form of criminal evidence. The study is structured into two primary sections: Nature and Characteristics of Facial Image Biometrics as Evidence, which delves into the definition and features of facial image biometrics as a form of evidence in criminal litigation. It explores the legal aspects of utilizing facial images as proof and the criteria that validate such evidence. The second section focuses on the perspectives of legal scholars regarding the process of capturing facial images for obtaining biometric data. The study concludes by highlighting key findings, emphasizing that conducting image capture operations by public authorities is justified, as long as these authorities disclose their surveillance procedures in advance, ensuring transparency to the public.
