Conclusions

This concluding chapter presents the fundamental question throughout the book: is it “just” bias and blindspots, or is it legal racism and culturalism? The ICC’s double standards for justice and accountability, its Western (only) cultural presumptions and its lens of whiteness have produced a track record of selective investigation and prosecution. These factors have been the backbone of judicial unfairness, which corrodes and erodes the legitimacy of international justice. The racism and culturalism reflected in the jurisprudence of the Ongwen Judgment underscore the urgent imperative of the struggles for equality and fairness on which the legitimacy of international justice hinges.
