Crossing Jurisdictional Lines: Translation Practices in International Corporate Law

Corporate law has its own challenges, but these pale in comparison to those that arise in international corporate law, as translation is so important in this area. This article explores translation practice in international corporate law and highlights some of the challenges and limitations of such practice. The introduction provides background information about globalization and its impact on the economy, which adds substance and makes the rest of the article easier to understand. By examining the concept of translation jurisprudence, this article also explores the unclear concept of “equivalence” in legal translation by illustrating best practices that practitioners can adopt. Despite the ambiguity of the concept of “equivalence”, a dynamic rather than a static concept of “equivalence” is still advocated to avoid distorted interpretations when legal decoupling is inappropriate and to make legal texts more functional. The benefits of translating laws into international corporate law are clear, but the humanizing impact of qualified legal translation on access to justice goes far beyond international corporate law and translation: the public and the media must understand the law in order to actively participate in ensuring that public affairs and Upholding the rule of law; legal translation makes Kelly's story accessible to all.
