Artificial Intelligence and International Arbitration

This chapter examines the expanding role of Artificial Intelligence (AI) in alternative dispute resolution (ADR), with a particular focus on international arbitration. The chapter highlights how AI has streamlined Online Dispute Resolution (ODR) processes by reducing time, effort, and costs through advanced algorithms that enhance negotiations and decision-making. Leading nations like China and the U.S. are at the forefront of applying AI to issue judgments and manage disputes, utilizing tools such as Lex Machina and DeepJudge to advance legal research and case analysis. In the field of arbitration, AI’s capabilities extend to the selection of arbitrators, aiding in identifying candidates with relevant experience and fostering diversity. Tools like AIQ and GAR’s Arbitrator Research Tool contribute to transparency and objectivity in this process. However, the chapter also addresses important concerns about AI’s impartiality and the potential for algorithmic biases to affect arbitrator selection and decision-making. AI is also revolutionizing document review and production by managing extensive and multilingual case documents through platforms like Relativity and Brainspace, significantly increasing efficiency. Despite these advancements, human oversight remains essential to address AI’s limitations and ensure accuracy.
