Horizontal Agreements in the Development of Energy Projects

In the energy industry, horizontal agreements refer to cooperative efforts between companies operating in the same part of the supply chain. These agreements have the capacity to enhance efficiency and promote innovation, but they may also give rise to antitrust concerns. We can employ various strategies like engaging in cooperative partnerships, forming alliances, encouraging information sharing, and coordinating our efforts. The legal framework regulates these agreements and scrutinizes them according to the competition regulations of the European Union. However, the complex nature of these agreements necessitates a comprehensive economic examination. The Commission’s approach is based on the belief that technology transfer agreements provide social benefits, but they can also lead to anti-competitive consequences. This chapter included a thorough examination of collaborative research and development (R&D) partnerships in the energy business. The main focus was on the goals, advantages, regulatory factors, and difficulties associated with these agreements. These agreements aim to improve cooperation among many stakeholders, such as industry participants, academic institutions, and governmental bodies, to tackle complex energy-related concerns. R&D partnerships can occur either through contractual agreements or through cooperative efforts that involve financial compensation.
