The Energy Charter Treaty

The Energy Charter Treaty is an internationally acknowledged agreement that aims to protect foreign investments and facilitate global trade between nations. The Energy Charter Treaty’s main purpose is to protect international investments, streamline the trading and transportation of energy resources, and establish channels for resolving conflicts. Nevertheless, there is a prevailing notion that the pact has become antiquated and does not conform to current norms. The aim is to guarantee conformity with sustainable development goals, tackle worldwide climate change problems, and set modern criteria for resolving conflicts between investors and nations. In 2019, the Commission received a mandate to engage in deliberations regarding the modernization of the Energy Charter Treaty. The objective of these discussions is to attain adherence to sustainable development, global climate change, and contemporary norms of dispute resolution between investors and the state. The mandate highlights various aspects, with particular emphasis on the EU’s current objective of transitioning to clean energy, as evident in the Green Deal. Ensuring that provisions pertaining to adherence to EU environmental and safety policies, as well as the Energy Charter Treaty, align with the objectives of the Paris Agreement is an integral aspect of the Commission’s deliberation mandate.
