As with other jurisdictions around the world, buying groups are common in Hong Kong among small and medium enterprises who individually have less market power. Hong Kong’s overall legal environment is conducive to the operation of buying groups, bolstered by its light-touch regulation and strong rule of law within a common law system. The city’s new competition law regime, enacted via the Competition Ordinance (Cap. 619), does not prohibit the operation of buying groups but regulates the operation of buying power. As specified in guidelines promulgated by the Competition Commission, buying groups could potentially contravene the Competition Ordinance. The jurisprudence in this area, however, is underdeveloped and further clarification by the Hong Kong Courts would be welcome.
