In Austria, the Austrian Patent Office handles trademarks, including their registration and cancellation. It is an administrative body, and therefore, the basis for its procedures is administrative law. Nonetheless, the Austrian Trademark Protection Act provides for an appeal against the decision of the Legal Department to the Higher Regional Court of Vienna, which is a civil law body. This dates back only to the year 2013 as before that time, only administrative bodies had competence in trademark matters.
