National and European Sovereignty in the European Union: An Irresoluble Conflict? The Position of the Czech Constitutional Court
摘要
This article seeks to argue that sovereignty is no longer attributable only to a State. It is also attributable to the European Union in areas of high politics. Its role is a functional, instrumental one: to legitimise and authorise the conferring of elements of the power of national authorities on supranational institutions as well as to safeguard ultima ratio their appropriate use.
