Analysis of Transportation Infrastructure Contract

Transportation infrastructure projects are still the largest share of government investment. The most commonly used standard form of international construction contracts in the world are FIDIC contracts. The primary research aim is the analysis and comparison of the FIDIC contract model regarding the relevant law of Bosnia and Herzegovina to conclude which model is the most adequate for the application of the construction of traffic infrastructure. The main goal of applying FIDIC is the balance of rights and obligations and the distribution of risks. The analysis found that the participants in construction contracts in Bosnia and Herzegovina have the most experience with the Red Book. The results showed that experts from this field, a total of 95.8% of them, met with the Red Book (M = 4.77), and the second-ranked was the Yellow Book (M = 3.22). Professionals who participated in the interview and survey (88.4%), based on their experience, agreed that the Red Book is the document with the most equal distribution of risks.
