Social Security Insurance in Case of Work Accidents in Palestinian Labor Law

It is known that Palestine was not an independent state from the past and did not have an independent social insurance system. However, the Palestinian government has developed some social protection and health insurance programs in recent years, and in cooperation with international and local organizations, retirement, disability, death and accident insurance programs have been created for public and private sector employees in Palestine. One of the most important of these programs is the National Insurance (Social Security) program launched in 2016. This program aims to provide comprehensive social protection for weak and poor groups in the country. In Palestinian law, the concept of work accident is defined as bodily harm that occurs as a result of work or on the occasion of doing this work and is caused by an external cause. The failure to implement the Social Security Law in Palestine due to political, economic, health and financial conditions leads to a decrease in workers’ rights, especially since these laws are generally enacted for the benefit of workers and to protect their rights. It should be said that, like all legal regulations in Palestine, legal practices regarding occupational health and safety are irregular and complex due to the chaos and war situations that the country has been in for years.
