The Constitutional Courts of New Democracies

This Chapter reviews the jurisprudence of the ECtHR citing the constitutional courts that emerged in Eastern and Central Eastern Europe, and in the Balkans, following the fall of the USSR and the subsequent democratic transition. The Chapter’s main objective is to provide an assessment of the ECtHR relationship with each national constitutional court. Each paragraph is substantially divided into two parts. The first part presents the main features of the national constitutional justice system and the second contains an analysis of the most significant judgments as well as an overall assessment of the relationship. The different Sections also contain graphs and charts illustrating the most salient quantitative data for each constitutional jurisdiction.
