Legal Regulation of the Use of Natural Resources as a Factor of Green Economic Growth

In today’s conditions, a natural resource as a source of human consumption of nature, a natural component, and a useful property is economically attractive and acquires an increasingly “property” meaning. The consumer characteristics of natural resources as a factor of green growth of the economy are the prerequisite for their use in a variety of areas. Given the characteristics of natural resources as material goods, the tasks of further development of environmental law should be the full adaptation of the industry and the relevant legislation to market conditions of economic management, the diversity of forms of ownership of natural resources, and economic entities. This research is based on a comprehensive analysis of the legal regulation of using natural resources, including combinations of different ways and methods. This research summarizes contemporary features of legal regulation of relations of nature use. It substantiates the conclusion about the necessity of attributing the right of general nature use to the system of environmental rights of citizens and its regulation within the framework of the institute of environmental rights, the main feature of which is the focus on satisfying environmental needs and ensuring the implementation of environmental interests. The authors conduct a detailed analysis of legal titles of natural resources belonging to economic entities, peculiarities of distribution by natural resources of the regime of private property, and other proprietary rights. Moreover, the authors defined the peculiarities of the authorization system in the area of special use of natural resources and concretized the peculiarities of contracts for using natural resources, which are the basis for their allocation in an independent group of contracts.
