Implementation of International Principles of Legal Regulation of Wages as a Factor of Environmentally Friendly Activities of Contemporary Cooperatives

摘要

This research studies the principles of legal regulation of wages. This research is based on the analysis of international conventional acts and the reflection of the norms contained in them in the current national (Russian) legislation. The authors note that the principles outlined in international acts have generally been implemented from transnational to current national legislation. Simultaneously, these principles are partially contained in the constitutional provisions, while in the sectoral legislation, they are disclosed more meaningfully. This research is based on the analysis of legislative norms of different levels. The authors note that the formulation of certain principles in Russian law is somewhat modified compared with the convention norms. Particularly, some elements are not specified, or, on the contrary, additional forms are established. It is also noted that some of the implemented principles are not reflected in the Basic Law, although the implementation mechanism presupposes the consolidation of their guarantee, which could be performed at the level of the Constitution. Additionally, the formulation of certain principles uses terminology that refers more to moral constructs than to legal categories, which consequently causes some difficulties in definitional analysis. The analysis has shown that it is necessary to further improve the current labor legislation in terms of regulation of the fundamental basis of the institute of wages, which will improve legislation and the practice of its application. Considering international principles within the framework of national legislation, the authors also paid attention to their application in collective agreements.
