Persons with alleged or clearly established disabilities are often involved in forensic matters, and neuropsychologists are frequently asked to evaluate such persons in the context of adversarial administrative or litigated matters. The purpose of the neuropsychological disability examination (NDE), also commonly known by the more generic independent medical examination (IME), is to determine whether the examinee has the cognitive, emotional, and/or behavioral capacity to perform the essential responsibilities of an occupation. Important differences exist between evaluations performed for clinical diagnostic and treatment purposes and those performed for the purpose of making determinations regarding disability status that are used to support or deny the awarding of disability benefits. Competent neuropsychologists, particularly when involved in interdisciplinary collaboration, are well suited to assist administrative decision-makers and triers of fact to arrive at determinations that are well founded and just. The purpose of this chapter is to provide a practical, collaborative approach to evaluations of neuropsychological disability in various forensic contexts.
