The chapter deals with the issue of the Roman-Germanic origin of the common law trust. It discusses the development of the feoffment to use, which was enacted in 1535, when Statute of Uses was passed by the Parliament. The chapter focuses on the flexible nature and major elements of the enfeoffment to use and discusses its roots according to different scholars’ (Frankel, Smythies, Herman, etc.) viewpoints and data of various dictionaries.
