Empirical Analysis of Advisory Proceedings

There is no express provision for amicus curiae participation in ICJ advisory proceedings. However, Article 66 ICJ Statute provides avenue for the participation of State and NSAs to submit information to the Court. This research applies empirical research methodology (Sect. 4.1) for mapping the ICJ practice concerning formal avenues of participation—based on the ICJ Statute or Rules—used by States, IGOs and NSAs for submitting relevant information to the Court in advisory proceedings, from 1947 to 30 April 2024 (Sect. 4.2).
