Due Process and Other Procedural Safeguards

The restrictive measures adopted by the European Union may have a significant negative impact on the life and rights of the targeted individual. The protection of individual rights in the context of restrictive measures has been significantly affected by the fact that the EU has adopted restrictive measures within the European Union’s common foreign and security policy. The aim of this chapter is to provide an overview of the evolution of the due process standards developed within the context of the adoption of restrictive measures. Regarding the central role of the European courts in this task, the main focus is put on the analysis of the respective case law in this regard.
