Three Types of Praxeological Constraints on Nomothetic Power

摘要

This article concerns the types of praxeological constraints on nomothetic power; that is, constraints that are inherent in the nature of the nomothetic act itself and exist independently of the norms in force in a specific system of norms. The praxeological constraints on nomothetic power are different in kind. In this sense, it is possible to draw a distinction among three different kinds of intrinsic constraints on the creation of rules: (i) hyletic constraints (that depend on the material structure of things), (ii) eidetic constraints (that depend on the eidos of things), and (iii) logical constraints (that depend on the logic itself).
