Liability-related issues are counted amongst the major risks associated with the use of AI. Indeed, liability ranks amongst the top three barriers to the use of AI by European companies and constitutes a major external barrier/challenge for companies that are planning to, but have not yet adopted AI (major obstacles to AI adoption). Therefore, the creation of a clear liability regime for AI and other emerging digital technologies plays a vital role in driving the industry forward, ensuring a level playing field, and reducing the uncertainties for companies considering investing in AI-powered products and services. Creating a stable liability policy and rules is indispensable in order to allow a sound basis for long term planning in the industry and set the environment for commercial initiative and massive investment.
