Decentralized Finance (DeFi) and Legal Challenges: Navigating the Intersection of Innovation and Regulation in the Fintech Revolution

The rise of decentralized finance (DeFi) signifies a shift in the industry blockchain technology to facilitate financial transactions without relying on traditional middlemen or intermediaries. This research delves into the implications brought about by the expansion of DeFi, examining the obstacles and opportunities it introduces for regulatory frameworks, contract enforceability and conventional understanding of financial dealings. By analysing DeFi platforms, smart contracts and the core tenets of decentralization authors highlight legal considerations such as adherence to existing financial laws, risks of fraud and market manipulation, privacy issues and enforcing agreements within a decentralized system. Furthermore, this research investigates ways in which legal systems can adapt to accommodate DeFi’s nature while safeguarding consumer interests, market credibility and financial stability. This study concludes that a balanced strategy involving both innovation and collaboration among stakeholders is crucial for leveraging the benefits of DeFi while managing associated risks effectively.
